Steps in the Process of Identifying Legal and Other Requirements



The organisation is required to identify its legal and other requirements and determine how these requirements apply to its environmental aspects.

This can be achieved by using a list of laws and regulations. An industry association may have undertaken som of this work and narrowed the scope of further investigation. The organisation can also seek advice from the sources of information listed previously.


Question to consider when undertaking this process :
Are permits/license/authorisations required? e.g. for : operation of the facility or processes, process/storm water discharges, air emissions, storage of materials, waste storage/disposal/transfer, use of specific substances (Where permits are required, examination of the permit conditions forms part part of the review).
Are there any limits on discharge or emissions, treatment requirements or monitoring and reporting obligations separate to any permit requirements?
Are there any specific requirements, e.g. preparation of emergency plans, that are likely to apply to the operation?
Are there works approvals applicable to any operation?
Is an impact Assessment required either from an internal protocol or through obligations? If so, under what conditions and criteria?
Are there any specified listed regional zones, flora or fauna affected by the operations? If so, what are the obligations for managing these?
Are there any requirements to notify the regulatory authorities which must be includes on the register and then communicated to appropriate personnel ?
